  • Employer Sponsorship: To apply for an H-1B visa, you must have a job offer from a U.S. company that will sponsor your visa application.
  • Cap Limits: Each year, there are only a certain number of H-1B visas given out. In recent years, the limit has been filled quickly, and a lottery system is used to pick the applications that will be processed.
  • Duration and Extensions: Generally, an H-1B visa is valid for three years, but it can be extended to six years.

  3. Lottery System: If the number of applicants exceeds the available visas, a lottery system selects the petitions that will proceed.

  • Time: The time it takes to process an H-1B application can vary. Using premium processing can speed things up to about 15 days but will cost extra.
  • Cost: The basic fee for entering the H-1B lottery registration is $215. If selected, additional fees apply including $780 for Form I-129 filing for larger companies, or $460 for smaller companies and non-profits.

In 2024, the Biden administration announced policies to improve the visa process especially for U.S. college graduates and DACA recipients. These changes might make it quicker and easier for these groups to get an H-1B visa.
